Check out the interview here. We discussed several specific cases.
Robert Ethan Miller is a case where three people have sworn out affidavits that say he’s wrongfully convicted. Randall Raar was convicted but by a twenty-one year old victim talking about an incident that happened when she was five. Robert Reynolds was convicted based on the testimony of three people: all of whom got deals. Tracy Martin said that prosecutorial misconduct led to his murder conviction.
There were four things I talked about which are important when considering wrongful convictions. First, as Jeff Deskovic told me, eyewitness testimony is the weakest form of testimony. Second, the Innocence Project found that one in four exonerations involves a false confession. Third, plea deals drive our criminal justice system. Finally, as in Robert Reynolds case, someone testifying as part of a deal has effectively taken a bribe, in my opinion. That testimony should not hold much weight if you are juror (again in my opinion).
Finally, I mentioned that Kim Kardashian deserves a lot of credit for amplifying the cause of wrongful convictions; and she does.
Thank you for writing this, this is a subject dear to my heart. Well said on all of this!
