Paul Boyne's new lawyers file to reduce bail, but he's still not happy.
Paul tells me the new boss is the same as the old boss, when it comes to his new court appointed attorneys.
It’s been relatively quiet in Paul Boyne’s trumped up, anti-first amendment case recently.
Paul, as long-time readers of Michael Volpe Investigates know, has been stuck in jails in Virginia and Connecticut on specious charges of cyberstalking for nearly a year and a half.
There is no trial in sight; Connecticut, which brought charges, doesn’t much care about his right to a speedy trial.
Paul is in jail for writing mean blog posts on his blog, thefamilycourtcircus.com. One person not sure that he’s been getting the shaft is first amendment expert UCLA professor Eugene Volokh. He listed most of the offending posts which he thought were criminal.
Judge Moukawsher “in the crosshair sight of a firearm” (¶ 17); “The judicial vengeance of Judge Moukawsher begs a .50 cal to the head” (¶ 18); talk of “assassinations” and “.50 caliber ammunition” (¶ 5); the items listed in ¶ 6; “is she beginning for a .308 shot to the head thru two panes of window glass from an oath keeper, concealed in the woods behind her house? A quick .50 cal to the head, delivered thru the back window of her car” (¶ 8); “worthy of a .50 cal to the head” (¶ 10); the Molotov cocktail stuff in ¶ 11; “Hunt Deichert!” and related material (¶ 12); “are there enough .50 cals for all the chosen heads in need of redemption?” (¶ 13); and more.
Professor Volokh was citing Paul’s arrest warrant. Despite his credentials, I vehemently disagree. We have a robust first amendment in the US, and this sort of political- yes political- speech is supposed to be protected. No one actually believes Paul was going to do harm, no one did harm, and the targeted judges who claimed to express fear were entirely performative.

The case has dragged on; in October, he fired his previous court appointed attorneys.
They were replaced with Kelly Denis O’Malley of the public defender’s office.
Both have been much more open with me than his previous attorneys, so I have no problems, however, Paul is very unhappy.
