This is extremely slimy, and it’s relatively common. What’s also common is for a parent to call CPS while trying to modify custody. If one party is looking to act aggressively in custody, Child Protective Services (CPS) is their friend. A motion to modify custody is likely to be followed by a call to CPS.
It should be obvious to everyone what’s going on except CPS is too busy protecting the identity of the accuser.
The strategy is often so blatant that courts do see through it. If a CPS hotline call happens shortly after a motion to modify custody is filed, it doesn’t take a brain surgeon to figure out who filed it.
Not always. The strategy is especially devious because the goal is to have an investigation stay open until there is a hearing. Then, the same parent who called in a bogus hotline call uses the open investigation they started to try and switch custody.
It can work.
