It’s been relatively quiet in Paul Boyne’s case since the fireworks on Halloween.
In an October 31, 2024, hearing, Boyne’s competence was questioned by his own attorneys- Jennifer Buyske and Alice Powers of the Kirschbaum Law Group.
Judge Peter Brown determined that Paul was competent, and Paul promptly fired his attorneys.
A man accused of cyberstalking for tormenting judges with malicious blog postings was found competent to stand trial Thursday and fired his public defenders for questioning his mental fitness.
The decision by Paul Boyne to discharge his two court-appointed lawyers puts his case, with its first amendment implications, on hold.
Paul haw written mean blog posts on his blog, thefamilycourtcircus.com, in which he says things like, “Judge Jane {Grossman} is begging for something. Jewdicial conduct which brings harm to children begs its own destruction…She has no place to hide, and her court is being watched closely.”
As I described in the Frank Report, the State of Connecticut is using specious legal reasoning to keep him in jail.
To say something not covered by the First Amendment, the writer must, among other specific carve outs, make a true threat.
A comment made in jest, or one no reasonable person could think is threatening, does not count.
In fact, the case which set this precedent is evidence of Paul’s innocence: Watts vs. United States.
In that case, an eighteen year old at a rally stated, “If they ever make me carry a rifle the first man, I want to get in my sights is L.B.J.”
The Supreme Court, in overturning his conviction, noted that “a threat must be distinguished from what is constitutionally protected speech.”
The court continued that political debate can at times be characterized by “vehement, caustic, and sometimes unpleasantly sharp attacks on government and public officials.”
That’s what Paul was doing, and everyone knows it.
In fact, he’s a political prisoner, in prison because he’s been exposing the misdeeds of judges.
Since the Halloween hearing, there has been little movement in Paul’s case, but that may be the calm before the storm, according to emails he sent me.
