Martin Lynch joins me to talk about this bill and how close it is to becoming law in Arizona.
HB 2675 would provide for a jury trial for any parent who could have their parental rights terminated by the Department of Children’s Safety (DCS).
Currently, a judge can decide to terminate the parents rights.
It was a rather high brow discussion. Martin cited Alexander Hamilton, the Federalist Papers, the 7th amendment, and the 14th amendment in his argument favoring the bill.
“We have a problem with CPS. They’re taking children for any reason and no reason. Where’s the checks and balances in the Constitution, to throttle that, and so, once you ask that question,” he stated in the podcast, “it’s not that big an endeavor to go into the Constitution and find where those are, and then bring those to the legislature and find somebody that says, ‘yeah, that’s a good idea.’ That’s where we are.”
